Terms of use for LogiNets services

1. GENERAL

This document contains the terms and conditions for the use of products and online services (hereinafter the Service) maintained by LogiNets Oy (hereinafter the Service Provider). By using the Service, the Customer has accepted the terms and conditions and undertakes to comply with them.

The service is subject to the IT2022 general terms and conditions. The IT2022 contract terms will be delivered to the customer when the order confirmation is sent. The IT2022 terms and conditions can also be downloaded from the LogiNets website. In matters not covered by these Terms of Use, the IT2022 Terms and Conditions shall apply.

In case there are any discrepancies with any language variations of the terms of use, the Finnish language version shall be referred to.

 

 2. NOPSA- service

 

2.1 GENERAL RESPONSIBILITIES AND OBLIGATIONS OF USERS (IN ADDITION TO IT2022)

The Customer is responsible for assessing the suitability of the Service for the Customer’s purpose.

 

Equipment

If the Customer uses the Service Provider’s Valtti card reader (hereinafter the device), the Customer is responsible for the installation of the device on site (must be connected to electricity), unless otherwise agreed in writing with the Service Provider. The Customer must check that after installing the device, timestamps will appear in the Customer’s account in Nopsa. The Customer must contact the Service Provider immediately if the device does not work. After installation, the Customer must also regularly check that the device is working and that the stamps from the device are visible in the Nopsa service.

 

Reporting Obligations to authorities

If the Customer uses the service to fulfill official obligations, the customer must check that the service is suitable for this purpose. The customer should read the software manual.

Obligations of the authorities include, but are not limited to:

  • Construction notices to the Tax Administration (employee notices and contract notices);
  • Reports for regional government agency inspections (AVI)

The Customer is responsible for the fulfillment of official obligations, even if the Customer uses the Service Provider’s Service as a tool for fulfilling of official obligations.

In the Nopsa service, it is possible to automate the sending of construction declarations to the Tax Administration in Finland (työntekijäilmoitus). The Customer must notify the Service Provider in writing if automatic transmission is to be enabled. The Service Provider sends automatic notifications on the 15th of each month or on the next working day with the previous month’s data. The Service Provider reserves the right to change the date of sending the notifications.

If the customer uses Nopsa to send a construction declaration (to the Tax Administration), the customer must ensure that:

  • The customer has produced the required data on a monthly basis for the service provider’s service (eg. the employees have made the required stamps with the Valtti card, the contract invoice data has been imported into the Nopsa system);
  • the content of the notifications is correct and truthful;
  • notifications are sent monthly;
  • The Customer has provided the necessary data for sending the notification before the Service Provider sends the automatic notifications to the Tax Administration on a monthly basis. If the customer has not produced the required data before the Service Provider sends the monthly notifications to the Tax Administration, the customer must send a report on the system himself.
    If there are deficiencies in the information, the Customer must complete the information and send the required notifications through Nopsa manually as a compensatory measure.

 

2.2 OTHER

If the Customer requests the Service Provider to create new users or user IDs for the Customer’s account, the Customer is obliged to ensure that:

  • The new user has the correct level credentials for the system;
    The new user’s information is correct
    Some features of the service retrieve information from external service providers for a fee (eg Vastuugroup, veronumero.fi service). The information and services of external service providers are subject to the terms and conditions of that service provider.

By using the service provider’s software, you authorize LogiNets to use your company’s logo in marketing materials as a “Customer Company”. If you do not wish to give permission to use your company logo in marketing materials, please notify our customer service in writing.

 

3. FIELD FORCE MANAGEMENT service

If the Customer requests the Service Provider to create new users or user IDs for the Customer’s account, the Customer is obliged to ensure that:

  • The new user has the correct level credentials for the system;
  • The new user’s information is correct
    Some features of the service retrieve information from external service providers for a fee. The information and services of external service providers are subject to the terms and conditions of that service provider.

By using the service provider’s software, you authorize LogiNets to use your company’s logo in marketing materials as a “Customer Company”. If you do not wish to give permission to use your company logo in marketing materials, please notify our customer service in writing.

 

4. MATERIAL HANDLING SYSTEM

If the Customer requests the Service Provider to create new users or user IDs for the Customer’s account, the Customer is obliged to ensure that:

  • The new user has the correct level credentials for the system;
  • The new user’s information is correct
    Some features of the service retrieve information from external service providers for a fee. The information and services of external service providers are subject to the terms and conditions of that service provider.

By using the service provider’s software, you authorize LogiNets to use your company’s logo in marketing materials as a “Customer Company”. If you do not wish to give permission to use your company logo in marketing materials, please notify our customer service in writing.

 

5. PERSONNEL AND VEHICLE GATES FOR CONSTRUCITON SITES

The Customer may rent or purchase gates for construction sites from the Service Provider.

These terms and conditions apply to the equipment agreed between the Customer and the Service Provider (hereinafter “Equipment”) as and with the supplies and accessories specified by the Service Provider in writing at the time of concluding the lease or sales contract. The equipment does not include the operating energy of the machines, lubricants or daily maintenance.

Upon receipt of the Equipment, the Customer is obliged to inspect the quantity, quality and condition of the Equipment. 

The Service Provider is not responsible for the safety of the structures that the Customer or a third party installs.

Customers responsibilities:

  • read and follow the instructions for use of the Equipment. If necessary, the service provider will provide guidance on the use of the Equipment.
  • use the Equipment carefully only for its intended normal use and under the conditions intended for it.
  • care for and maintain the Equipment properly. Equipment maintenance should be provided by qualified personnel.
  • to monitor any excess stress caused to the Equipment by wind, snow and water loads and to take the necessary measures required by the situation without delay at the customers own expense.

The Customer is obliged to compensate the Equipment destroyed, lost or otherwise not returned during the rental period to its new acquisition value. The Customer is also obliged to compensate the Service Provider for the damage and costs caused to the Equipment during the rental period due to negligent or incorrect handling and inadequate maintenance.

If the equipment in use requires repair during the rental, the Customer must notify the Service Provider without delay. Primarily, the Service Provider will supply the customer with the required parts for repair. The customer must have the Equipment repaired by a qualified person. The Service Provider is not responsible for repairs to the Equipment caused by the Customer’s intent, negligence, misconduct or failure to follow the installation, use and authority instructions or an event caused or associated with criminal / criminal activity.
